This waiver, release, covenant not to sue and indemnify deed executed on this in favor of Dallas Tamil Manram and Nanban Foundation, a non-profit organization, (hereinafter referred as the “Forum”) by the Benefactor and agree as follows:

1. That the Forum is willing and offering its services to its members and other people of its programs as a non-profit corporation including peace walk, picnics, sports and such other programs for the benefit of the community.
2. The Benefactor is voluntarily accepting such services offered by the Forum for the benefit of the Benefactor and its immediate family members including minor children. The Benefactors are voluntarily participating or attending the programs offered by the Forum and is not accepting the same for any reason other than to
obtain the benefit there from.
3. The Benefactor hereby consent the Forum, its officers, agents, employees, insurers, successors, and its supporting organizations, its officers, agents, employees, insurers, successors, voluntary persons to deliver the services offered by the Forum to the Benefactor and its family members.
4. The Benefactor on behalf of himself/herself and on behalf of its family members including the minor children hereby assume all risk involved in participation of such programs offered by the Forum arising therefrom even though such risks may arise out of negligence or carelessness of the Forum, it’s officers, agents, employees, insurers, successors, and its supporting organizations, or voluntary persons or anyone associated with the Forum in offering such services to the Benefactor and its family members.
5. By accepting the services and having read this document and understanding the representation made herein, the undersigned on behalf of himself, its family members including minor children or any person on behalf of the Benefactor is entitled to act, waive and release the Forum, and its supporting organizations, officers, agents, employees, insurers, successors, voluntary persons from and against all claims, demands, disputes, actions or causes of action which may accrue to the Benefactor while accepting the services offered by the Forum by the reason of any injury, illness, damages, expenses which may arise out of any negligence or carelessness or other acts of the Forum or its supporting organizations, officers, agents, employees, insurers, successors, and voluntary persons.
6. The Benefactor for themselves and on behalf of its family members including minor children hereby agree to indemnify and hold harmless the Forum, its supporting organization, its officers, agents, employees, insurers, successors, and voluntary persons, from any loss of liability, damages or costs including but not limited to attorney fees and court costs that may incur in any suit, demand or legal action or claim of any nature made by any of the undersigned or its family members arising out of the alleged injury, damages, or death resulting directly or indirectly from the participation of the above activities, whether such injury, damages, or death resulting directly or indirectly from the participation of the above activities, whether such injury, damages, or death is alleged to or does result out of negligence or carelessness on the part of the Forum or any one representing or acting for it.
7. The Forum or its agents or supporting organization will have right to use the information, all photographs, motion or video pictures, recordings and other references or records of the programs mentioned above for general use and publicity purposes.
